While Title IX does not specifically use the terms “transgender” or “gender identity or expression,” courts have held that harassment and other discrimination against transgender and gender nonconforming people constitutes sex discrimination. It is important to note that prior to the enactment of AB 1266, both state and federal law have prohibited gender-based discrimination for some time.
